Court Halts Attempts of Improper Community Land Registration Process in Taita Taveta | Mramba Community Land

The Elc (Environment and Land Court) at Mombasa on Monday 4 th May 2022 stopped attempts of improper registration of Mramba Community Land belonging to members of 8 sub-locations, saying the decision of Taita Taveta Community Land Registrar to issue the notice for the meeting to elect CLCM was done despite objections from members of the community.

 

As seen by CLAN! one of the reliefs sought by the applicants through Kertiony Advocates was anorder of prohibition to both Community Land Registrar and County Commissioner Taita Tavetafrom calling an election of Community Land Management Committee members for Mramba Community Land until full public education participation of community members is attained.

In 2021 October, Taita Taveta MCAs passed a motion to compel the executive to stop the
registration of community land in Taita Taveta.

 

“This assembly urges the county executive to stop the registration of community land until the process of documentation, mapping, community engagement and developing of the inventory of the land is duly completed,” stated the motion that the MCAs overwhelmingly approved in a session chaired by temporary Speaker, Mata Ward Representative Chanzu Khamadi.

The Kasigau Ward Rep claimed several unregistered parcels of land were at the risk of being
grabbed if the exercise was not carried out in a transparent manner.

  1. Our communities should embrace rule of law when conducting businesses for registration of their land. There are clear rules or laws that governs the registration process and should be follow to reduce set backs in the process.
